Then lead prosecutor Michael Chertoff took advantage of the opportunity and exploited it for all it was worth. Even though this matter involves nothing more than an idiot using a computer much as one would use a phone to make pranks calls, this case has excellent publicity value. Again, an element shared with the Wachtler matter. The NJ US attorney's office has been the springboard for Sam Alito and Michael Chertoff. Chris Christie is being groomed as the "next big thing" to come out of NJ, so a case like this (borderline meaningless prosecution, major publicity potential) is a much sought after commodity for Christie. What we really need from this office is a press release outlining Chis Christie's and Todd Christie's criminal fundraising efforts on behalf of the BCF. Additionally, Todd Christie's ability to do a "Houdini" with his federal criminal charges is worthy of investigation. Even though the facts demonstrated otherwise, the government's theory was that she should have been sentenced as if she knowingly and willfully participated in a scheme to disseminate her client's "militant" message. The truth is that this is simply another effort to stifle dissent by reminding defense lawyers that they, too, have liability in their clients' affairs. The government essentially believes that a lawyer who zealously defends a client somehow becomes a party to the crime, particularly if his efforts are successful. She was very fortunate to have been sentenced by a judge who was willing to defy government prosecutors. Richard Jewel, Dr. Wen Ho Lee, and Dr. Stephen Hatfield are just some of the better known citizens who have had their lives destroyed by the FBI's shoddy investigative practices. Add to this endemic incompetence an irrational need for favorable publicity and you have a recipe for a complete law enforcement disaster. One day I had the pleasure of being visited by some of these government wanna-be tough guys. It was like something out of a cheesy mafia movie. There was one guy doing the talking while being backed-up by two goons. They claimed they were investigating a "homicide." Their "investigation" stemmed from a government prosecutor who was found murdered in a known pick-up spot for homosexuals seeking sex. The government initially tried blaming some "rappers" who were being prosecuted by this individual at the time of his murder. When the news broke I went into a Yahoo chat room with some choice comments about the affair. I cannot remember exactly what I wrote, but I'm sure it is archived somewhere. By the time they got around to visiting me, it was already known that their all-American type prosecutor actually led a double life which resulted in his being murdered in a gay lovers' lane. He was obviously not murdered by rappers or even bloggers. This did nothing to prevent the FBI from "investigating" the matter from my front door. I suspect they came in the hope that I would make the mistake of speaking with them. It is exactly this type of "informal" visit which typically leads to subsequent charges of making false statements. Unless you want to be the next Martha Stewart, NEVER, EVER SPEAK WITH ANYONE FROM THE GOVERNMENT WITHOUT AN ATTORNEY PRESENT!!! My refusal to speak resulted in them threatening me with "We're going to have to question your neighbors." I told them to do what they do best and terrorize the whole neighborhood. With that parting shot I closed my front door. Pirro's office is as guilty as any other prosecutor's office of abusing the legal process in order to inflict maximum damage to defendants. All of this reminds me of Nicholas Bissell who was a prosecutor in New Jersey. He has a reputation for seeking the maximum sentence available whenever possible, regardless of its appropriateness. This policy became a problem when Bissell, himself, was convicted and sentenced to 10 years in federal prison. Bissell fled and was finally cornered in a seedy hotel in Reno, Nevada. The US Marshals surrounded his hotel room and demanded his surrender. (BTW, this completely violated the feds agreement with Bissell's wife. She agreed to assist in his apprehension with the condition that he not be cornered. Evidently, she knew her husband would likely not be taken alive.) As Mrs. Bissell feared, her husband was a true coward and blew his brains out once he realized there was no way out of the hotel. His last words were reportedly, "I can't do 10 years!" Nick Bissell was indeed unable to do his 10 years, but this did not in any way temper the sentences he sought for others.
